Our Guide to: Conveyancing
If you're considering buying or selling a property in England, you're embarking on an exciting journey! Before you start choosing paint colours or packing boxes, it's essential to understand the conveyancing process.
Having a good understanding of the legal process involved in buying or selling a residential property in England can really help take the stress out of the process. While it may sound daunting, it’s a straightforward procedure that ensures the legal transfer of property ownership.
What Is Conveyancing?
Conveyancing refers to the legal process of transferring property ownership from one party to another. Think of it as passing the baton in a relay race, but with a lot more paperwork involved!
The Conveyancing Process: A Step-by-Step Overview
Choosing Your Legal Representative
This initial step is crucial. You'll want to select a qualified conveyancer or solicitor with experience in property transactions. Look for recommendations, read reviews, and compare fees. Once you've chosen, your legal representative will send you a client care letter outlining their terms of service and fees. They'll also request identification documents and proof of address to comply with anti-money laundering regulations.
Completing the Necessary Forms
For sellers, this involves filling out several important documents:
- Property Information Form (TA6): Provides detailed information about the property, including boundaries, disputes, and planning permissions.
- Fittings and Contents Form (TA10): Lists what items are included in the sale.
- Leasehold Information Form (TA7): Required for leasehold properties.
Buyers' conveyancers will review these forms and begin their investigations into the property's legal status.
Conducting Searches and Surveys
Your conveyancer will conduct various searches, including:
- Local Authority searches: Reveal planning permissions, building control issues, and nearby developments.
- Environmental searches: Check for contamination, flooding risks, and other environmental factors.
- Water and drainage searches: Confirm connection to mains water and sewerage.
Simultaneously, it's recommended that buyers arrange a property survey to identify any structural issues or necessary repairs.
Addressing Queries
After reviewing all documents and search results, your conveyancer will raise enquiries with the other party's solicitor. These could relate to unclear information in the forms, issues highlighted in searches, or concerns from the survey. This stage often involves back-and-forth communication to resolve all queries satisfactorily.
Reviewing Mortgage Offers
If you're buying with a mortgage, your conveyancer will carefully examine the mortgage offer to ensure all terms are acceptable and match the property details. They'll explain any conditions attached to the offer and ensure you understand your obligations.
Exchange of Contracts
This is when the transaction becomes legally binding. Both parties sign identical contracts, and the buyer typically pays a deposit (usually 10% of the purchase price). Your conveyancer will conduct final checks before exchange, including a bankruptcy search on the buyer and a final land registry search.
Completion Day
This is the day when ownership legally transfers. Your conveyancer will:
- Arrange for the transfer of funds
- Ensure all conditions of the contract are met
- Register the change of ownership with the Land Registry
- Handle the payment of Stamp Duty Land Tax (if applicable)
For buyers, you'll receive the keys and can move into your new property. For sellers, you'll need to vacate the property and hand over all keys.
Each of these stages involves numerous legal checks and procedures, which is why having an experienced conveyancer is crucial for a smooth property transaction.
